Contract Check/Property Report
Are you still deciding whether you should sign the Contract and pay the deposit requested by the Developer/ Seller?
We can provide you with our complete property report to help you to make this decision.
In our property report we will:-
- Explain the terms and conditions of your Private Purchase Contract;
- Examine all of the documentation supplied to us and highlight any problems shown by the supplied documentation. Recommend further enquiries which should be made.
- If you are purchasing a new build we will carry out a Company Search of the Developer's Company to make sure it exists and is solvent and we will also check that the Developer has been issued with planning permission.
- We will also carry out a search of the Land to confirm the registered owner and description of the land.
Power of Attorney
Is it difficult for you to attend the offices of the Spanish Notary?
It is a requirement of the Spanish Legal system that all buyers and sellers attend a Notary Public in Spain in order to complete the transfer of the property. You can, however grant a Power of Attorney authorising another person to attend the Spanish Notary and sign the title deeds on your behalf.
Powers of Attorney are frequently used in Spanish property transactions. The document gives authority to the named third party to carry out specific actions such as signing documentation, handling bank accounts, spending and receiving money, taking out a mortgage or loan.
We will prepare the Power of Attorney in English and Spanish and arrange for it to be legalised by a UK Notary. We do offer an in-house Notary Service.
NIE Application
Every buyer or seller of a Spanish Property must have a Spanish NIE number (Spanish fiscal number) before the Title Deeds are signed. The NIE application must be made in person. The application can be made at the Spanish Consulate in London or alternatively at the Police Station local to the Spanish Property (you will need to make enquiries as rules vary depending on the location of your property). If you require any assistance with this then we will charge £90.00 plus VAT per NIE application.
Administration of a Spanish Estate
We can deal with the administration of a Spanish Estate. Spanish inheritance tax may need to be paid to the Spanish tax authority and this should be paid within certain time limits.
